How the Conveyancing Process Works

Every property transaction is different, but most follow a similar structure.

For buyers:

  • Offer accepted – once your offer is agreed, we step in to carry out the legal work.
  • Checks and searches – we review the contract, title deeds, and carry out searches with local authorities and utility providers to make sure you know exactly what you’re buying.
  • Mortgage and funding – We’ll work closely with your mortgage adviser to facilitate the offer process and liaise with your lender on any specific requirements for your transaction.
  • Exchange of contracts – this is when the transaction becomes legally binding and a completion date is fixed.
  • Completion – we transfer the money, you get the keys, and the property is officially yours.

For sellers:

  • Preparing documents – we receive title deeds, draft the contract, and provide information about the property.
  • Responding to enquiries – we answer questions raised by the buyer’s solicitor.
  • Exchange of contracts – we agree on a completion date and commit to the sale.
  • Completion – once the buyer’s funds are received, we redeem any mortgage, pay estate agent fees, and transfer the balance to you.

How long will it take?

A straightforward transaction may take between 8 and 12 weeks, but timing depends on factors like chains, mortgage offers, and searches.

 

What is exchange of contracts?

It’s the point where both parties commit to the transaction. Before exchange, either side can withdraw without penalty. After exchange, penalties may apply.

 

Do I need a survey?

Surveys aren’t a legal requirement, but they give you valuable information about the property’s condition. 

 

What happens on completion day?

Funds are transferred, the seller’s solicitor confirms receipt, and you get the keys.

 

Can you act for both buyer and seller?

No. To avoid conflict of interests, we can only act for one party in a transaction.
